Terms and Conditions of Sale
These Terms and Conditions apply to all sales of trailers, parts, accessories and related goods supplied by Monybuie Ltd trading as D&G Trailers (“D&G Trailers”, “we”, “our” or “us”) to any customer (“the Customer”, “you” or “your”).
By placing an order with D&G Trailers you agree to be bound by these Terms and Conditions.
1. Formation of Contract
1.1 A quotation does not constitute a contractual offer.
1.2 A contract is formed only when D&G Trailers accepts your order and issues an invoice or written confirmation.
1.3 We reserve the right to refuse any order.
2. Prices
2.1 All prices are quoted in Pounds Sterling (£).
2.2 VAT will be charged where applicable.
2.3 Prices may be amended prior to acceptance if a pricing error has occurred or supplier prices change.
3. Payment
3.1 A deposit may be required when placing an order.
3.2 The balance must be paid in cleared funds before collection or delivery unless otherwise agreed in writing.
3.3 We reserve the right to cancel any order where payment is not received by the agreed date.
4. Retention of Title
Ownership of all Goods shall remain with Monybuie Ltd until payment has been received in full.
Risk in the Goods passes to the Customer immediately upon collection or delivery.
5. Deposits
Deposits are non-refundable where:
- goods have been specially ordered;
- goods have been built or modified to the Customer’s specification;
- we have incurred costs specifically relating to the order.
Any refund on standard stock items shall be entirely at the discretion of D&G Trailers.
6. Delivery and Collection
Delivery dates are estimates only and are not guaranteed.
Customers collecting trailers must inspect the Goods before leaving our premises.
Where delivery is arranged, the Customer must inspect the Goods immediately upon receipt.
Storage charges may be applied to trailers not collected within fourteen (14) days after notification that they are ready unless otherwise agreed.
7. Used Trailers
Used trailers are sold according to their age, condition and reasonable wear.
Customers acknowledge that cosmetic imperfections consistent with age and previous use should be expected.
Any defects specifically disclosed prior to sale shall form part of the Contract.
8. Warranty
Unless otherwise stated in writing, trailers and other Goods supplied by D&G Trailers may be covered by a manufacturer’s warranty. Any manufacturer’s warranty is provided by the manufacturer and is subject to the manufacturer’s own terms, conditions, exclusions and servicing requirements.
Copies of the relevant manufacturer’s Warranty Handbook are supplied with the trailer where applicable and are also available via our website. Customers should ensure they read and retain this documentation.
Customers are responsible for ensuring that all servicing, maintenance and inspections required by the manufacturer are carried out within the specified intervals. Failure to comply with the manufacturer’s servicing and maintenance requirements may invalidate the manufacturer’s warranty.
Where D&G Trailers administers or undertakes warranty work, all warranty claims are strictly Return to Base.
Under our Return to Base warranty policy:
- The Customer is responsible for returning the trailer or Goods to D&G Trailers for inspection and repair.
- The Customer is responsible for all transport, recovery, delivery and collection costs associated with returning the Goods to our premises.
- D&G Trailers does not provide on-site warranty repairs unless agreed in writing.
- No warranty work may be carried out by a third party without our prior written authorisation.
- Any unauthorised repair, alteration or modification may invalidate the warranty.
The warranty does not cover:
- fair wear and tear;
- accidental damage;
- misuse, abuse or neglect;
- overloading;
- failure to maintain the trailer in accordance with the manufacturer’s recommendations;
- corrosion or deterioration caused by environmental conditions;
- consumable items including tyres, brake linings, bulbs, batteries and cosmetic finishes unless defective at the time of supply.
Manufacturer Warranty Information:
Please refer to the relevant manufacturer’s warranty handbook available on our website or supplied with your trailer. These documents form part of the applicable manufacturer’s warranty terms.
9. Inspection and Claims
The Customer must inspect all Goods upon collection or delivery.
Any shortage, transport damage or obvious defect must be reported within 48 hours.
Failure to notify us within this period may affect the ability to make a claim.
10. Returns
Returns of unwanted standard Goods may only be accepted with our prior agreement.
Returned Goods must:
- be unused;
- be complete;
- be in their original packaging where applicable;
- be in a condition suitable for resale.
- Special order, bespoke or customised Goods cannot normally be returned unless faulty.
- Return carriage costs are the responsibility of the Customer unless otherwise agreed.
11. Faulty Goods
Nothing within these Terms affects your statutory rights.
Where Goods are found to be faulty, D&G Trailers will inspect the Goods and provide an appropriate remedy in accordance with applicable consumer legislation.
12. Finance
Any sale subject to finance approval shall only proceed once finance has been approved.
Should finance be declined, D&G Trailers reserves the right to cancel the order.
Finance Disclosure
D&G Trailers is an Introducer Appointed Representative of AFS Compliance Ltd, which is authorised and regulated by the Financial Conduct Authority (Firm Reference Number: 625035).
D&G Trailers is authorised to introduce customers to AFS Compliance Ltd for the purpose of arranging finance. We do not provide independent financial advice or make recommendations in relation to finance products.
Finance is subject to status and affordability. Terms and conditions apply. Not all applications will be accepted.
We may receive a commission or other remuneration for introducing customers to AFS Compliance Ltd or its panel of lenders. If you would like further information about any commission we receive, please ask and we will provide details in accordance with regulatory requirements.

13. Part Exchange
All part exchange valuations are subject to inspection.
If the condition differs materially from that declared, we reserve the right to amend or withdraw the valuation.
The Customer warrants they have legal title to any trailer offered in part exchange.
14. Limitation of Liability
Nothing in these Terms excludes liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any liability that cannot legally be excluded.
Subject to the above, D&G Trailers shall not be liable for indirect or consequential losses including loss of profit, business interruption or loss of opportunity.
Our total liability shall not exceed the purchase price of the Goods.
15. Force Majeure
We shall not be liable for delays or failure to perform our obligations where such delay results from events beyond our reasonable control including adverse weather, transport disruption, supplier shortages, industrial disputes or government action.
16. Privacy
Personal information shall be processed in accordance with our Privacy Policy.
17. Governing Law
These Terms and Conditions shall be governed by the laws of Scotland.
Any dispute shall be subject to the exclusive jurisdiction of the Scottish Courts.
18. Statutory Rights
Nothing within these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable legislation.
